1. Acceptance of Terms
These Terms of Service govern access to and use of the E10 website and services. By using E10, users agree to these Terms and applicable policies. Users who do not agree should not use the services.
2. About E10
E10 is a technology platform operated by D.A.N Global LLC. E10 provides software and digital tools used by independent participating organizations and donors to support charitable and community giving experiences.
E10 may facilitate the digital experience and integrated payment flow, but E10 is not itself the charitable beneficiary. The organization selected by the donor is the intended recipient of the contribution.
3. Eligibility
Users must have the legal capacity to use the applicable service and must comply with applicable laws. If consent or authorization from another person or organization is legally required, the user is responsible for obtaining it.
4. User Accounts
Users must provide accurate information, keep account details current, protect login credentials, and take reasonable steps to prevent unauthorized access. Users are responsible for activity they authorize through their accounts and should promptly report suspected misuse.
5. Participating Organizations
Participating organizations are independent entities. E10 does not own or control an organization merely because it uses E10.
Unless expressly confirmed for a specific service, E10 does not guarantee an organization's charitable or tax status, the tax treatment of a contribution, the organization's conduct, or its use of funds. Donors should review information supplied by the organization before contributing.
6. Contributions
Donors choose the participating organization they wish to support. E10 provides technology that facilitates the contribution experience, while the selected organization is the intended recipient.
Tax treatment may depend on the recipient organization, the nature of the contribution, and applicable law. Users should consult their own tax adviser where appropriate.
7. Payments
Payment processing may be provided through integrated payment service providers, including Stripe where applicable. Those providers may collect and process payment information under their own terms and privacy policies.
Payment completion and settlement may depend on the participating organization, provider requirements, and applicable law. A provider's role in processing payments does not represent an endorsement of E10.
8. Recurring Contributions
A user who authorizes a recurring contribution may be charged according to the amount and frequency selected until the recurring contribution is cancelled or otherwise terminated through available service controls. Changes or cancellations apply according to the controls presented in the service.
9. Fees
Certain transactions or services may include disclosed fees. Applicable fees will be presented where relevant before completion of the applicable transaction or service.
10. Receipts and Records
E10 may provide access to contribution history, records, receipts, or acknowledgments where available. These materials do not guarantee that a contribution is tax-deductible or replace professional tax advice.
11. Acceptable Use
Users may not use E10 for unlawful activity, fraud, impersonation, abuse, unauthorized access, malware, interference with the service, misuse of payment systems, infringement of third-party rights, or attempts to bypass security or service controls.
12. Intellectual Property
E10 branding, software, website content, and platform materials are protected by applicable intellectual-property laws. Users may not copy, modify, distribute, or exploit those materials except as permitted by law or written authorization.
Users and organizations retain ownership of content they submit. They provide the permissions reasonably necessary for E10 to host, process, display, and use that content to operate the requested services.
13. Third-Party Services
E10 may link to or integrate with third-party services. Those services are operated independently and may have their own terms, privacy policies, availability, and requirements. E10 is not responsible for third-party services beyond responsibilities imposed by applicable law.
14. Service Availability
E10 may update, maintain, suspend, or change aspects of the service for operational, security, legal, or product reasons. Continuous or error-free availability is not guaranteed.
15. Disclaimer
E10 provides technology services and does not provide legal, tax, accounting, or investment advice. Information made available through E10 is general and should not replace advice from a qualified professional.
To the extent permitted by applicable law, services are provided as available, without guarantees that every feature will always be uninterrupted or suitable for every purpose. Rights that cannot legally be limited remain unaffected.
16. Limitation of Liability
To the extent permitted by applicable law, D.A.N Global LLC will not be responsible for indirect, incidental, special, or consequential losses arising from use of E10. This provision does not exclude or limit liability that cannot legally be excluded or limited. No specific monetary liability cap is established by these Terms.
17. Indemnification
To the extent permitted by applicable law, users are responsible for claims arising directly from their unlawful use of E10, fraud, or violation of third-party rights. Any indemnification obligation is limited by applicable law and any separately agreed terms.
18. Termination
Access may be suspended or terminated when reasonably necessary to address violations of these Terms, unlawful activity, fraud, security threats, service misuse, or legitimate operational requirements. Applicable rights and recordkeeping obligations may continue after access ends.
19. Changes to These Terms
These Terms may be updated to reflect changes to E10, applicable requirements, or business practices. The effective date will be revised when updated Terms are published, and additional notice may be provided where required.
20. Governing Law and Disputes
These Terms are subject to applicable law. No specific governing state, mandatory venue, arbitration requirement, or class-action waiver is established here. Nothing in these Terms waives rights or remedies that cannot legally be waived.
